Bad luck. That sounds rotten and I'm sure that's not right for online sales. I'd write to them quickly and explain the mistake.

In their NO REFUND exceptions it says:

'As otherwise required by law (e.g., in certain jurisdictions, where a 7-day grace period on distance purchases is mandated).'

So, I reckon that covers you. How you get a refund is anyone's guess, as there are no direct contact details listed, which is surely bad practice. That TopSpin company looks like a kind of broker for other sellers. And I think they say that you have to contact the company on the sales receipt, which is strange as they seem to take the money. But there is a link for support. I would persevere. They must be legally obliged to refund within the cooling off period.

Topspin seem to be huge and have a wikipedia PR page, listing all the big acts they provide merchandising services for. But they have no direct contact information for the public.

If you paid by Paypal you can dispute the transaction. They will take the money back off Topspin until the case is resolved. As they won't have sent the goods yet, they will probably just agree to a refund.

If you paid by Credit Card you can reverse the transaction (you certainly can in the UK anyway)

If you paid by Debit Card you're probably stuffed.

I'm surprised that they still have the flexi edition for sale though? I thought that was super limited??

Just call the card/bank and cancel the payment. May be too late now, though.

It's also on spincds at ?2 less (not sure what they charge for postage).

Thanks for all the info guys. I did email them to see if I could stop the sale and got an email reply the next day. They said it had already shipped, but they told me not to open the package (I assume they meant the cd packaging) but I didn't even open the shipping box to be safe. The box arrived the next day and I pasted a new label with the return address given, along with my RMA# to the box then went directly to the post office and shipped it back with a tracking number. They said they would happily refund my purchase price less shipping ($16.00; kinda high in my opinion, but equally understandable) I will keep everyone posted when the credit is received on my credit card. I think I jumped so quickly because the blog about the 3rd album had the link to order WL/WH "WITH Flexi" on the same page. That was the only mention of a flexi and I assumed it was a link for the 3rd album with flexi. I should have taken a moment to read it completely and I would have seen it was for an earlier release with the SAME song on the flexi. Oh well; my haste cost me $16 shipping plus $5.18 return shipping but it was a lesson well learned. BTW, Has anyone heard about a Flexi for the 3rd album? I have searched all over and nothing so far but if anyone hears of one, please post it here. thanks so much :?
