Warhol Tapes: Legal Issue

Post by alfredovu »

Dear friends,

We are all well excited about having access to this "Warhol treasure". I´m the first absolutelly delighted about that. First thing I do in the morning when I arrive to my office is cheking in this site looking for the "new" cut.
I was warned by a very good friend of us about the legal problems the site & administrators can face if the legal owners of the tapes & recordings ear about the publishing here. This is not legal at all. This is not selling bootlegs or CD-r´s. They can trace you.
We all want have all these cuts safe at home. It´s for free and it is nice (big thanks are due to Rosie Lee and the guys running this site!) but they are taking a BIG RISK for us, and I think we should be carefull.
Speed up the thing us much as you can and then take it out.

Alfredo - I heartily agree - I didn't mention it before as I used to go on about rights etc on the old yellow forum, and people don't seem to get it. I'm glad this stuff is getting out there, but there could be repercussions.

Alfredovu mentioned "the guys running this site" as being responsible for leaking the tracks. I must admit that I am a bit worried about this stuff and because I'm not sure if it will be obvious enough to someone potentionally looking into this stuff on behalf of the Warhol people or the VU's record company, I feel that I have to stress for the record that I had nothing whatsoever to do with making the files available, and that my opinion on leaking them was not asked at any point. It was all between Rosie Lee UK and ferges and I found out about the files like everyone else here.

I have let ferges know my opinion many times and as a matter of fact I asked him to cancel my admin rights at one point because of this stuff - I did and do not want to accept any responsibility for something I had nothing to do with. Hence, I am no longer an administrator of this site - the moderator title is basically a "ceremonial" one (for having started the site and stuff) as really I just post here like anyone else.

I never made one of you "responsable" for this. I just "warned" you, as administrators, about the RISK of posting the songs in the site you are running.

Don't sweat it folks, the site is not currently hosting anything illegal, the files have been pulled. They now reside in a private email account, which Yahoo will simply delete if the museum's lawyers start complaining. But I doubt anyone at all is aware of this, we're not exactly Napster here, and I doubt it would cause a convulsion of litigation even if they do become aware of it. They usually give you a "cease and desist" notice as a first warning. If you ignore that, then you're asking for a fight.

Which is not to trivialize anyone's sensible words of caution.
